Information on the mandatory recording of guests' personal data

Pursuant to the legislation in force, after 1 September 2021, all guests using accommodation services in Hungary are obliged to provide their personal data via the document reader of the accommodation provider.

Pursuant to the legislation in force after 1 September 2021, the personal data of the guest using the accommodation service in Hungary must be recorded by the accommodation service provider in the accommodation management software and then transferred to the Guest Information Closed Database.

Pursuant to the current legislation, after September 1, 2021, the personal data of all guests using accommodation services in Hungary specified in the law must be recorded in the accommodation provider's software via the document reader of the accommodation provider and then transferred to a storage location, the Guest Information Closed Database.

Legislation in force:

• Law CLVI of 2016 on the state tasks of the development of tourist areas.
• Government Decree (X. 15.) 235/2019 on the implementation of the Act on State Tasks for the Development of Tourist Areas.
• Government Decree (XII. 23.) 414/2015 on the issuance of an identity card and on the rules for uniform portraiture and signatures.

Data to be recorded:

• family and first name
• birth surname and first name
• place of birth
• date of birth
• gender
• citizenship
• mother's birth surname and first name (if included in the identification document)
• identity or travel document identification
• in the case of a third-country national, the number of the visa or residence permit, the date and place of entry.

Third-country national: Annex II to the 2007 Act on the entry and residence of third-country nationals under the law.

To record the data, the guest using the accommodation service must present an identification document, his/her identity card, driving license or travel document to the accommodation provider. In the absence of presentation of the document, the accommodation provider is permitted to refuse the accommodation service. Based on the authorization of the legislation, the accommodation service provider is entitled to request the guest's identity document, and the guest is obliged to present it.

In the case of children under the age of 14, the presentation of an identity document will be mandatory from 1 January 2022.
